He was married to Annie Irene Hambrick and Katie Lee Whitaker and had Lucile in 1920. On 22 Feb 1928, Burley killed Walter R. Tolbert and meant to kill Wiley Stanmore Harrison, Jr. and was arrested. Burley was given the death penalty. Burley died on May 22, 1931, at 11:29 AM, 8 days after his birthday. He died in "old sparky" the electric chair due to being executed for murder. He was buried at cemetery #30 on May 24, 1931, 2 days after his execution.
