Son of Benjamin Franklin and Rose Ann (Newkirk) Hays.
He married Adella Fulks, daughter of Sarah James (Black) and Henry Alexander Fulks, on December 25, 1906, in Latham, Moniteau County, Missouri. They left the Midwest for California shortly after getting married.

Frank was a carpenter by trade and worked with his brother, Joe. They helped to build the University of California at Berkeley.
